The Hamline Law Alumni Board is sponsoring an Alumni CLE titled, "Federalism and the Individual Health Insurance Mandate: The Limits of Federal Power and the Courts' Jurisdiction."
This CLE will preview the upcoming Supreme Court argument on the constitutionality of the individual mandate provision of the Affordable Care Act. Professors Pagonis and Holcomb, experts in health and tax law , will explain the role of the individual mandate in health care reform and evaluate the questions that will be addressed during the Court's three days of oral arguments in March: Is the individual mandate in fact a tax, precluding judicial review of its constitutionality? Is the individual mandate a lawful exercise of Congress' powers under the commerce clause and necessary and proper clause? And, finally, if the individual mandate exceeds Congress' authority,what does this mean for the rest of the Affordable Care Act?
