As 2007 comes to a close, I would like to take a moment to wish you peace and joy throughout the coming year. Hamline Law School Announces New Assistant Dean Darrell Davis

Darrell J. Davis brings 25 years of legal experience and a strong commitment to ‘human interests' to new role as Assistant Dean of Student and Multicultural Affairs

Darrell J. Davis, an experienced attorney with 25 years of professional experience, has joined Hamline University School of Law as assistant dean of student and multicultural affairs. He is responsible for all matters involving student life at Hamline law school, as well as retention and supporting Hamline's commitment to enhancement of inclusive excellence in the law school.

Davis most previously was corporate attorney director at Graco, Inc., from 1992-2007. Earlier, he served as senior attorney and managed litigation at Honeywell, Inc. in Minneapolis. Davis worked as special assistant attorney general for the state of Minnesota from 1981-1986. He also has served as an adjunct professor at William Mitchell College of Law. Davis earned a juris doctorate from the University of Minnesota School of Law and a bachelor of arts degree from the University of North Carolina at Chapel Hill. He is a member of the American Corporate Counsel Association-Minnesota chapter, the American Bar Association, the Minnesota Black Lawyers Association, and the Minnesota State Bar Association.

"For the past 25 years I have represented products and assets," Davis said. "At this point in my career I want to represent human interests. Hamline University School of Law was especially attractive to me. This law school offers rigorous, professional legal education within a pro-student, family-type environment that I'm looking forward to continuing to foster."

ABA Journal Highlights Hamline’s JD/MFA Degree

National attention is growing for Hamline's innovative program, which is designed to educate lawyers capable of exploring social and political issues through fiction and creative nonfiction

News of Hamline's first-in-the-nation joint degree in law and creative writing made the national ABA Journal in December. In the article Dean Garon describes that the one of the main drivers behind the degree was the "growth in public policy books aimed at general readers. Increasingly, lawyers have moved to the public arena to affect social policy. (Read the article at http://www.abajournal.com/magazine/creative_thinking/).

"There's tremendous interest in writing books, articles and documents that open up new avenues of public dialogue," Dean Garon is quoted as saying. The article also described that Hamline "hopes to attract law students who want to explore a range of creative writing." Dean Garon reports that he already has fielded inquiries from poets, playwrights and "many others who find the combination of law and writing to be compelling." Spring Law and Leadership Speakers: Dean Veryl Miles and Justice Sam Hanson

The Hamline Law and Leadership program features prominent leaders in the legal community who provide reflective analysis of the profession's leadership opportunities and obligations. Continuing in this tradition, Veryl Miles, dean and professor at The Catholic University's Columbus School of Law, will be joining the Hamline community on February 28, 2008 and Minnesota Associate Justice Sam Hanson will speak on March 17. Both presentations will be at 11 a.m. at Hamline University and are free of charge and open to the public.

Veryl Victoria Miles is a graduate of Wells College in Aurora, New York and a law graduate of The Catholic University of America. She teaches consumer bankruptcy and several courses in commercial law. Much of her scholarship has been devoted to the subject of consumer bankruptcy law. She has taught at the Columbus School of Law since 1987. During the years of 1997-1999, Dean Miles served as the associate dean of Academic Affairs at the law school.

Prior to joining the faculty at CUA, Dean Miles was on the law faculty at George Mason University School of Law. She also has taught in the summer school program at Washington University School of Law in St. Louis, Missouri, and served as an adjunct professor at the American University of Law in Washington, D.C. Dean Miles served as the Deputy Director of the Association of American Law Schools from August 2001 to August 2003. She was named dean of the Columbus School of Law in 2005.

Justice HansonMinnesota Supreme Court Justice Sam Hanson (at right) will have served as an Associate Justice on the state's highest court for five years when he retires from the bench on January 1, 2008. Prior to his service on the court he served as a judge on the Court of Appeals for two years. Governor Jesse Ventura appointed Justice Hanson to the Court of Appeals in 2000 and to the Supreme Court in 2002. Justice Hanson plans to return to private practice with Briggs and Morgan in January 2008.

Justice Hanson received his B.A. from St. Olaf College, and attained his LL.B. (cum laude) from William Mitchell College of Law. He was a law clerk for the Honorable Douglas K. Amdahl, then on the Hennepin County District Court, in 1964-65, and for the Honorable Robert S. Sheran on the Minnesota Supreme Court in 1965-66. Justice Hanson began the practice of law with the firm of Briggs and Morgan in 1966 and continued there for 34 years, serving at various times as the chairman of the litigation department and president of the firm

Dean Garon to Discuss Cutting Edge Technology and Business Success at CES Book Event

Dean Jon Garon, author of Own It: The Law and Business Guide to Launching a New Business through Innovation, Exclusivity and Relevance will appear at Borders Express as part of the International Consumer Electronic Show in Las Vegas.

A nationally recognized authority on intellectual property, Hamline University School of Law Dean Jon M. Garon will be appearing in Las Vegas to meet with technology and entertainment industry's greatest innovators on how to incorporate those innovations into their business plans.

Garon's latest work, Own It-The Law & Business Guide to Launching a New Business through Innovation, Exclusivity and Relevance, provides entrepreneurs the critical understanding of how to build long-lasting value for business through intellectual property and innovation. Garon offers advice on maximizing the opportunities for financing, planning, and competing in the e-commerce economy using common sense examples and the successful strategies of world-renowned companies.

Helpful Hints for Year-End Giving


Many questions arise regarding the timing of the transmittal of various types of gifts to not-for-profit organizations when they come at the end of the calendar year. As a service to the alumni and friends of Hamline University School of Law, here is a quick overview that may be helpful as you consider your own charitable giving for 2007.

The general rule is that a gift is considered having been made at the time the donor relinquishes control of the asset.

  • Checks sent via the U.S. Postal Service. The date of the gift is the postmark on the envelope, not the date on the check itself.
  • For items sent via third party, such as FedEx or UPS, the gift date is the date the not-for-profit signs for the package, not the date it was sent. This is because the donor can still recall the package.
  • DTC stock transfers are considered gifts when the asset is deposited in the not-for-profit brokerage account, not the date the donor instructs the broker to make the gift. Pay close attention to this one. Every year there is a flurry of activity as donors make the call to their brokers in the last few days of December. It is not unusual for some of these last minute gifts to miss the deadline of December 31. Plan early for stock transfers.
  • It is also a good idea to notify the not-for-profit of stock transfers. Some brokerage firms do this for the donor, many do not and tracing the gift can be cumbersome after the fact. If the brokers do not notify the not-for-profits, then it can be very difficult to find out who to credit and thank for the gift.
  • Stock gifts made by transferring the actual certificate should be done by sending the certificate in one envelope or package and the stock power in a separate envelope or package. Note: the gift is considered complete based on the postmark of the latter of the two mailed envelopes or when the latter of the two packages (i.e. Fed Ex or UPS) is signed for by the not-for-profit.
  • Gifts by credit card are deductible in the year when the charges are made on the card owner's account. It is not the date you go online to fill out the form or authorize a gift office to charge your account. I.e. you may charge the gift on Dec. 20 but your credit card company may not process it until the January statement. This would be considered a 2007 gift. It is best to plan early for this type of gift.
  • Finally, please know that the IRS considers it the donor's responsibility to verify the date of the gift. Therefore, many not-for-profits indicate on gift receipts the date your gift was processed by them, not the actual gift date. It is a good idea to keep accurate records for gift made near calendar year end.

On November 20, local entertainment lawyers John Stout of Fredrikson & Bryon and Daniel M. Satorius Vice President Lommen Abdo Cole King & Stageberg, P.A. and Co-Chair of the Entertainment Law Department joined Dean Jon Garon for an information-packed discussion on the role lawyers should play in invigorating Minnesota's film business. Panelists explained that making movies in Minnesota involves much more than identifying interesting scripts and scouting locations. Lawyers must be involved in the process of raising capital, preparing and reviewing contracts, protecting intellectual copyright and other key issues.

 

Dr. Konish

On November 16, Dr. Ron Kronish, director of the Interreligious Coordinating Council in Jerusalem and former director of the Israel Office for the American Jewish Committee, and co-director for the Melitz Centers for Jewish Zionist Education, spoke at the first of a series of breakfast discussions being sponsored by the Journal of Law and Religion. Dr. Kronish spoke on "The Role of Religion and Interreligious Dialogue in Peace-building in Israel and Palestine."

Brooker

Earlier in the fall, Assistant U.S. Attorney Greg Brooker presented an overview of the grand jury system. While grand juries are independent of all branches of government, Booker explained that prosecutors wield considerable influence over grand juries since they screen jurors, present evidence, summarize witness testimony, and read the indictment. Prosecutors also can provide legal advice to the grand jury. He also noted that is very difficult to undo what a grand jury does.

Jewish Law and the Ethics of Warfare

Professor Daniel Sinclair is a visiting professor at Fordham Law School in New York City and also teaches Jewish Law; Comparative Bio-Medical Law, Jurisprudence and the History and Principles of the Common Law at the College of Managment Law School, Rishon Lezion, Israel.  Professor Sinclair is an ordained Orthodox rabbi and has served as the rabbi of the Edinburgh Hebrew Congregation and as Dean of Jews' College, London.  He has published numerous articles in the fields of Jewish law, bio-medical law and the application of Jewish law in the legal system of the State of Israel, and books including "Tradition and the Biological Revolution," and "Jewish Biomedical Law: Legal and Extra-legal Dimensions."

The Journal of Law and Religion will provide a continental breakfast for participants who RSVP (lberglin@hamline.edu) no later than February 15. The event is open to the public, so alumni should feel free to attend and to invite colleagues.

4th Annual Juris Fiesta Endowment Celebration & Dinner

In 2005, with the support of Dean Jon Garon and Professor Tom Romero, the Hamline Latino Law Student Association inaugurated the Juris Fiesta. The Juris Fiesta also recognizes the importance of LLSA's membership to the maintenance of a rigorous and inclusive 21st century legal education. Indeed, the Juris Fiesta brings Lationo/as, esteemed members of the bar and judiciary, professionals from the business sectors, and Hamline's community together to recognize the wide-ranging achievements of Hamline's Latino/a law students and alumni during the past year.

Our guest speaker this year will be Professor Elizabeth Iglesias from the University of Miami School of Law. Professor Iglesias holds a Bachelor of Arts (magna cum laude) from the University of Michigan and a Juris Doctor (with honors) from Yale Law School. She is the Co-Founder of Latina and Latino Critical Theory, Inc. (LatCrit, Inc.) which she incorporated in 1998 and co-directed until 2003. In 1997, she designed the Project for Legal Economic, Development, Justice and Equality (PLEDJE) an innovative clinical program to promote micro-business development, immigrant rights and the use of NAFTA labor and environmental side accords through workshops, community based study circles and outreach to underprivileged high school students.

Professor Iglesias has received numerous honors and awards as a scholar, activist, citizen and poet including the Most-Outstanding Faculty Award by the UM Public Interest Law Group, the Dean Thomas Lecture, Yale Law School, Women Who Make Difference. In 2003, Professor Iglesias Co-Founded LisaLeine Productions, a multimedia production company devoted to the advancement of human rights through the creation of exhibition and distribution of independent film and art. Her first documentary entitled Scaring Miami: Anarchists, RoboCops and Corporate Globalization explores the mass convergence of labor, environmental, peace and justice activists in Miami to protest the Free Trade Area of the Americas.

Professor Iglesias has been a licensed private pilot since 2003. She received her Instrument Flight Rules(IFR) Rating in 2006.

"The 60th Anniversary of the Declaration of Human Rights: A Reality Check"

This symposium sponsored by the Hamline Journal of Public Law and Policy will gather U.S. and international scholars, law practitioners, and government officials to reflect on more than half a century of the Declaration's commitment to the recognition and protection of the inherent dignity and of the legal and inalienable rights of all members of the human family" around the globe. It will also address the future challenges in fulfilling the aims of the Declaration in promoting respect for personal rights and freedom.

There will also be a symposium dinner event on Thursday evening, March 13 at 6:00 p.m. at the University Club in St. Paul.

CLE credits will be applied for.

Law & Leadership Series Welcomes Justice Sam Hanson

Former Minnesota Associate Justice Sam Hanson will speak on "Guardians of the Common Law: The Fine Line Between Judicial Responsibility and Judicial Activism". He will review decisions that implicate separation of powers concerns in the expansion or contraction of the common law.

Hanson served as an Associate Justice on the state's highest court for five years when he retired from the bench on January 1, 2008. Upon leaving the court, he returned to private practice with Briggs & Morgan. Prior to his service on the court he served as a judge on the Court of Appeals for two years. Governor Jesse Ventura appointed Justice Hanson to the Court of Appeals in 2000 and to the Supreme Court in 2002.

Hanson received his B.A. from St. Olaf College, and attained his LL.B. (cum laude) from William Mitchell College of Law. He was a law clerk for the Honorable Douglas K. Amdahl, then on the Hennepin County District Court, in 1964-65, and for the Honorable Robert S. Sheran on the Minnesota Supreme Court in 1965-66. Justice Hanson began the practice of law with the firm of Briggs and Morgan in 1966 and continued there for 34 years, serving at various times as the chairman of the litigation department and president of the firm.

James Moore ’85 has been chosen as a finalist by Governor Pawlenty to fill a vacancy in the Fourth Judicial District in Hennepin County.

Todd Bjerke '84 was elected as a trial court judge in Wisconsin and began his six-year term on the bench in La Crosse County the first of August, 2007. He is currently a Colonel in the Judge Advocate General Corps of the United States Army Reserves, assigned as the Staff Judge Advocate for the 88th Regional Sustainment Command at Fort McCoy, Wisconsin.

Jeffrey Carpenter ’84 has joined Henson & Efron as a partner and member. His practice will focus on banking, real estate, and business presentation.

Jeffrey Baill '80 has been awarded the 2007 Don Kramer Award by the National Association of Retail Collection Attorneys at their annual meeting in Atlanta. Jeffrey was honored for his longstanding impact on the legal profession as the founder of the National Association Subrogation Professionals.

Kathleen Martin '80 has been elected chair of the ABA Section of Real Property, Trust and Estate Law for the 2007-2008 bar year.

Joshua Kindkeppel '03 and Caryn Christianson were married on August 5, 2007 in Madison, WI. Joshua is an attorney with Eustice, Laffey, Sebranek, & Auby, S.C. in Sun Prairie, WI. His practice focuses on business and real estate transactions, employment law and civil litigation.

Jonathan Reppe '95 and Liz Robb '95 were married on October 19, in Nerstrand, MN. Jonathan practices out of his firm, the Reppe Law Office in Northfield and Liz manages the Washington County Law Library in Stillwater. The couple resides in Northfield.

Phillip Trobaugh '91 and his wife Elizabeth Lake, announce the birth of their first child, son Dutcher Maclean Lake Trobaugh.

Susan Lynn Paul '86 passed away on November 6, 2007, in Fitchburg, Wisconsin surrounded by her family.

Karen Saxhaug Walden '86 passed away from complications associated with a rare type of T-cell lymphoma.

FACULTY NOTES- December 2007

Two Hamline law professors and an alumna were presenters at the third bi-annual Statewide Restorative Philosophy and Practices Conference. Professor David Larson conducted a workshop exploring ways in which technology can assist and support restorative justice titled "Alternative Dispute Resolution and Technology." Professor Howard Vogel and alumna Penelope Harley '02 presented a workshop titled "Bringing it Home: Truth Commissions and the North American Experience." 

Professor David Larson made a presentation at the Sixth International Forum on Online Dispute Resolution in Hong Kong on December 4. The Forum is organized by the United Nations Economic and Social Commission for Asia and the Pacific in collaboration with the Hong Kong International Arbitration Centre, the University of Hong Kong, Faculty of Law, the China International Economic and Trade Arbitration Commission. 

Angela McCaffrey and Ann Juergens presented their co-authored paper, Role Plays as Rehearsals for "Doing the Right Thing" Teaching Ethical Practice in Moldovan and U.S. Clinical Legal Education at a scholarship development roundtable, Nov. 9, 2007 at Washington University School of Law.  The article will be published in volume 28 of the Wash U Journal of Law and Policy.   

Hamline Health Law Institute Director and Professor Lucinda Jesson was interviewed in December by Minnesota Public Radio regarding the U.S. Supreme Court argument about federal preemption of some state court claims respecting medical device manufacturing. 

Professor Tom I. Romero II was featured in a recent article in the Denver Urban Spectrum on Mexican American desegregation cases. 

Kenneth Tilsen, a longstanding adjunct and supporter of Hamline, was honored with the 11th Annual Earl Larson Award by the Minnesota Chapter of the ACLU.
